¿Qué es un «Team Name»?

Un «team name» es una terminología creada estatutariamente, descrita en la Sección 10159.7 del Código de Negocios y Profesiones. Esencialmente, representa:

  • A professional identity or brand name.
  • Used by a seller and one or more real estate licensees.
  • Implemented for the provision of real estate services.

Componentes Esenciales de un «Team Name»

  1. Surname inclusion: It is essential that it contains the last name of at least one of the team members, in conjunction with words such as:
    • «group»
    • «team»
    • «associates»
  2. Allowed words: Términos como «realty» o «real estate» son permitidos, siempre que se cumplan las otras condiciones, como el ejemplo: «Smith Real Estate Team».
  3. Prohibitions: It is essential to avoid words that could lead the public to believe that the team is an independent entity from the responsible rider. These include:
    • «broker»
    • «real estate brokerage»
    • «real estate broker»

Publicidad y «Team Names»

  • Not a fictitious name: Según la Ley de Bienes Raíces, un «team name» no es considerado como un nombre comercial ficticio, lo que significa que no es necesario presentar papeles adicionales al DER para usarlo.
  • Advertising requirements: Advertising materials must:
    • Mostrar el «team name».
    • Include the last name and license number of at least one of the licensed members.
    • In certain circumstances, highlight the identity of the responsible broker, either through name, license number, or both.

Identity of the Responsible Broker

La «identidad del broker responsable» es un concepto definido en la Sección 10015.4 del Código de Negocios y Profesiones. Esta identidad:

  • It represents the name under which the broker is licensed.
  • It may include the name and/or associated license number.
